DISCUSS MY SITUATION

Immigration procedures shouldn't feel uncertain.

In Nepal, securing residency or lawful work authorization is rarely a one-desk task. It requires synchronized approvals across the Department of Immigration, Department of Industry, Line Ministries (Health, Education, or Infrastructure), the Ministry of Home Affairs, and the Inland Revenue Department.

Immigration Nepal provides upfront procedural certainty. We clarify statutory prerequisites, verify eligibility thresholds, and audit physical documentation dossiers before any official government submission takes place.

Before submission Practical case support

A pre-filing document review can identify missing information before submission.

What we clarify before you commit

  • Precise Visa Classification: Identification of the exact statutory category matching your physical purpose rather than makeshift tourist stays.
  • Notarization & Authentication Standards: Home-country apostille or embassy attestations required by Nepalese ministries.
  • Inter-Ministerial Approvals: Line-ministry recommendations, Labor Department clearances, and Department of Industry endorsements.
  • Strict Statutory Timelines: Realistic operational sequencing to prevent lapse into 150-day tourist overstay penalties.
  • Entry & Re-entry Conditions: Multi-entry endorsements and foreign travel provisions without jeopardizing status continuity.
  • Post-Approval Tax Responsibilities: Employer PAN registration, individual withholding taxes, and annual audit filings.

Questions we are often asked

Concise, statutory answers to routine procedural uncertainties encountered by international clients in Nepal.

Which visa do I need to work lawfully in Nepal?

Foreign nationals cannot work lawfully in Nepal under a Tourist or Business visa. Lawful employment requires a formal Working Visa issued by the Department of Immigration following a labor permit recommendation from the Department of Labor and Occupational Safety and line ministry endorsement. Expatriate staff quotas also apply.

Can a tourist visa be converted into a business or working visa inside Nepal?

Yes. Foreign nationals holding an active tourist visa may convert into a Business or Working visa from within Kathmandu, provided all statutory approvals (e.g., Department of Industry foreign direct investment registration or Ministry work permit clearance) are finalized before the tourist visa's validity or annual 150-day limit expires.

What documents are required to obtain a business visa for Nepal?

Key prerequisites include: Company Registration Certificate from the OCR, Department of Industry FDI Approval or Shareholder Ledger, Tax Clearance / Audit Certificate, Bank Inward Remittance Certificate verifying legal fund transfer into Nepal, and an official Department of Industry recommendation letter.

How long can a foreign national remain in Nepal each calendar year?

Under statutory immigration rules, foreign nationals holding a Tourist visa may remain for a strict maximum of 150 days per calendar year (January 1 to December 31). Stays beyond 150 days without transition to a statutory visa category (Business, Non-Tourist, Working, or Dependent) incur per-day statutory fines and overstay penalties.

Can foreign companies sponsor personnel without a registered entity in Nepal?

Generally no. Sponsorship of working or long-term business visas requires an onshore legal presence, such as a registered subsidiary, registered branch office, or bilateral project counterpart. Our desk advises international firms on optimal structure selection to achieve lawful personnel residency.

What is the procedure for extending an existing business or dependent visa?

Visa extensions must be initiated at least 15 to 30 days before expiration. The process involves submitting an updated annual tax clearance certificate, annual progress report to the Department of Industry, active relationship confirmation (for dependents), and lodging the extension request at the Department of Immigration in Kalikasthan.
